Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website solaar.mariansan.io (the “Site”), operated by Marian Sanjur (“Solaar”, “we”, “us”, or “our”) from the Republic of Panama.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. About Solaar

Solaar is a demonstration project presenting the concept of an AI development agency built with a custom stack of AI agents. The Site is intended for informational and showcase purposes only. No paid products or services are offered or sold directly through the Site at this time.

Any engagement for actual services will be governed by a separate written agreement between you and Solaar.

2. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) to use the Site or submit information through the contact form or email signup.

3. Use of the Site

You agree to use the Site lawfully and respectfully. In particular, you agree not to:

  • Use the Site in violation of any applicable law or regulation.
  • Attempt to gain unauthorized access to any part of the Site, its servers, or related infrastructure.
  • Interfere with, disrupt, or overload the Site (e.g., denial-of-service, scraping beyond reasonable levels, automated crawling against stated restrictions).
  • Reverse engineer, decompile, or otherwise attempt to extract source code or underlying AI models, except as permitted by law.
  • Submit false, misleading, defamatory, infringing, or unlawful content through any form or channel.
  • Use the Site to transmit malware, spam, or harmful code.
  • Impersonate any person or entity or misrepresent your affiliation.

We reserve the right to restrict or terminate access to the Site at any time, without notice, for any reason, including suspected violation of these Terms.

4. Contact form and email signup

When you submit information through the contact form or subscribe via email signup, you represent that the information is accurate and that you are entitled to share it. Your information will be handled according to our Privacy Policy.

Submitting a message does not create any business, contractual, consulting, or advisory relationship between you and Solaar.

5. Intellectual property

All content on the Site — including text, graphics, logos, code samples, UI design, AI-generated outputs displayed as demonstrations, and the “Solaar” name and branding — is owned by Marian Sanjur or licensed to us, and is protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and view the Site for personal, non-commercial informational purposes. You may not copy, reproduce, distribute, modify, publicly display, or create derivative works from any part of the Site without prior written permission, except:

  • Brief quotations for commentary, criticism, or news reporting with proper attribution.
  • Any materials we explicitly make available under an open-source or Creative Commons license (where those license terms then control).

All rights not expressly granted are reserved.

6. User-submitted content

If you submit ideas, feedback, inquiries, or other content through the Site (“Submissions”), you grant Solaar a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, and adapt such Submissions for the purpose of responding to you, improving the Site, and operating the demonstration. You represent that your Submissions do not infringe any third-party rights.

We are under no obligation to treat Submissions as confidential unless a separate non-disclosure agreement has been signed.

7. AI-generated content and demonstrations

The Site may display outputs generated by AI systems (“AI Output”) as part of its demonstration purpose. You acknowledge that:

  • AI Output may be inaccurate, incomplete, biased, or otherwise unreliable.
  • AI Output is provided for illustrative purposes only and must not be relied upon for legal, financial, medical, or other professional decisions.
  • Solaar makes no warranty as to the fitness, accuracy, or suitability of AI Output for any particular purpose.

Any use you make of AI Output is at your sole risk.

8. Third-party services and links

The Site relies on third-party infrastructure and services, including but not limited to Vercel (hosting), Google Analytics 4 (analytics), CookieYes (consent management), and may link to external websites or repositories (e.g., GitHub, LinkedIn). We do not control and are not responsible for third-party services or their content. Your use of third-party services is governed by their own terms and policies.

9. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.

Solaar does not warrant that the Site will be error-free, secure, or continuously available, or that any defects will be corrected. You use the Site at your own risk.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SOLAAR OR MARIAN SANJUR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those cases, the above limitations apply to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless Solaar and Marian Sanjur from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of:

  • Your use or misuse of the Site,
  • Your violation of these Terms, or
  • Your infringement of any third-party right.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Panama, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Panama City, Panama, without prejudice to any mandatory consumer protection rights you may have in your country of residence.

If you are a consumer resident in the European Economic Area or the United Kingdom, nothing in these Terms affects your mandatory statutory rights.

13. Changes to these Terms

We may modify these Terms from time to time. The “Last updated” date reflects the latest version. Material changes will be announced on the Site. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

14. Language

These Terms are provided in English and Spanish. Both versions are intended to have equivalent meaning. In case of any discrepancy, the English version shall prevail.

15. Severability and entire agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Solaar regarding the Site and supersede any prior understandings.
